End-User License Agreement

Introduction

Please read this License agreement carefully before using this Library. By purchasing the Library, you are agreeing to be bound by the terms of this License. If you do not agree to the terms of this License, do not purchase this Library.

Royal Albert Hall Organ is a product and trading name of Enigma Recordings Limited, a private registered company in England and Wales (company no. 12855104). Our registered place of business is 10 Tottenham Mews, London, W1T 4AF and our VAT number is 357591659.

License Grant

You are purchasing a single user License for Royal Albert Hall Organ, for commercial or non-commercial use without further licence fees or royalties. The rights associated with this License are available to you as an individual only, and transfer of the License to another individual, third party or entity is strictly prohibited without express written permission from Enigma Recordings Ltd. You have the right to install this Library on three computers provided they are exclusively owned and used by you, the Licensee, as an individual.

Enigma Recordings Ltd retains copyright ownership of all recorded sounds, instrument programming, documentation and musical performances included within each product. All past and future versions of any Enigma Recordings Ltd product, including any versions previously published or sold through any other entity are fully bound and covered by this agreement. All rights not expressly granted are hereby reserved.

Ownership & Protection

This Library and any included graphics, documentation, audio files, programming and other intellectual property are exclusively owned by Enigma Recordings Ltd, and licensed to you on a non-exclusive basis. This license is non-transferable and expressly forbids resale or lease of the Library. The License is perpetual and effective from the date of installation. You warrant that the name entered during completion of the purchase order is your full and correct current legal name.

The License also forbids any redistribution or inclusion of the content, including but not limited to, re-selling, resampling or embedding into software or hardware of any kind, for the purpose of reproduction as part of any free or commercial musical sample or sound effect sample playback system or device.

You agree to protect this Library from unauthorized use or duplication. You may not decrypt, decompile, reverse-engineer or attempt to derive the source code of, modify or create derivative works of the Library.

Refunds

All sales are final and we cannot provide refunds once a download has been attempted, initiated, completed and/or a serial number has been activated.

Breach

In the event of a breach of this agreement, action may be taken against you by Enigma Recordings Ltd, the owner of the copyrighted materials, or its successor in interest. You agree that any court action to enforce the terms of this agreement will occur in the United Kingdom. The non-prevailing party in any action brought for breach of this agreement will be responsible for payment of the prevailing party’s attorney fees, costs, court fees, and resulting damages.

Liability

The Licensee shall not hold Enigma Recordings Ltd responsible for any loss of business or business profits resulting directly or indirectly from the performance of the Library. Enigma Recording Ltd does not warrant against misuse of the Library with regards to infringement of third party rights, and makes no representations or warranties with regard to any websites or information displayed or accessed through the Library or the included documentation and resources.

General

This Licence shall be governed by the law of England and Wales, and you agree that this is the complete agreement between the parties. You acknowledge that you have read this agreement and fully understand the terms and agree to be bound by it. Enigma Recordings Limited and the Royal Albert Hall have worked together to create Royal Albert Hall Organ and the Royal Albert Hall receives a donation of five percent of the profit from the licensing of this product.
